Abstract: This 15 page report discusses the concepts associated with mediation processes and discusses the ways in which cultural, social, and personal biases can have a significant impact on the successfulness of the outcomes reached through mediation. Mediation has become an effective and beneficial means of dispute settlement in a number of circumstances. The mediator creates a safe and encouraging environment for deliberation, fostering new ideas, shuttling settlement options back and forth and focusing attention on feasible solutions. The process is not only cheaper than litigation but more geared to fixing what is broken. The most important thing to understand is the fact that in the vast majority of situations the potential drawbacks of mediation are few while the benefits are many. However, cultural considerations must be seen as extremely important in the overall establishment of a successful mediation program. Bibliography lists 12 sources.
